1. Acceptance of Terms
By accessing or using the SPDAFY Creator-Tech Engine (the "Platform"), you agree to be bound by these Terms of Service. These terms apply to all creators, developers, and users of our automation and distribution services.
2. Eligibility & Age of Majority
The Platform is intended for use by professional creators. By using the Platform, you represent and warrant that you have reached the age of majority in your province or territory of residence, or that you have obtained verifiable parental consent where required by law.
3. Description of Service
SPDAFY provides a proprietary software engine utilizing Artificial Intelligence (including Gemini 3.1 Pro and Vertex AI) to automate content distribution, SEO optimization, and visual analysis. The Platform is currently in a Beta phase, and features may be added, modified, or removed at any time without prior notice.
4. User Responsibilities & API Usage
You are responsible for maintaining the security of your creator accounts and API keys. You agree not to use the Platform for any illegal purpose, including the distribution of copyrighted material without authorization or the generation of prohibited content via our AI interfaces.
5. Intellectual Property
You retain all rights to the creative content you process through our engine. SPDAFY retains all rights, title, and interest in the Platform's proprietary algorithms, codebases, and AI-driven orchestration logic.
6. Limitation of Liability
As a Beta service, the Platform is provided "as is" without warranty of any kind. To the maximum extent permitted by applicable Canadian law, DJ SPDAFY shall not be liable for any damages arising from the use or inability to use our services.
7. Governing Law & Dispute Resolution
These terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts located in Ontario.
8. Severability
If any provision of these terms is found to be invalid or unenforceable under Canadian law, that provision will be severed, and the remaining provisions will remain in full force and effect.
